Terms of Service for Kyoko

1. Acceptance of Terms

By inviting, interacting with, or using Kyoko ("the Bot") in any Discord server or Direct Message, you agree to these Terms of Service. If you do not agree with these terms, you must cease interaction with the Bot and remove it from any servers you manage.

2. Data Collection and Privacy

To provide its core features, the Bot collects and stores certain data. By using the Bot, you consent to the following:

Identifiable Information

The Bot collects and stores your Discord User ID and Guild (Server) IDs to track your virtual economy balances, inventory, and XP progression.

Message Content & AI Context

When interacting with AI commands (e.g. !ask, !chat, !truth), the Bot processes your message content to generate responses. A short history of your conversations and AI-determined "personality traits" are temporarily stored to maintain context.

Data Deletion

You retain the right to clear your AI conversational memory from the Bot's database at any time by using the clear_memory slash command.

Storage

Data is stored locally in JSON files and SQLite databases. The Bot developer will not sell or distribute your data to third-party marketers.

3. Voice Channel and Audio Processing

The Bot includes voice features, including voice-activity XP and speech-to-text recognition.

Voice XP

The Bot monitors voice channel presence to award virtual Experience Points (XP). It logs when you are in a voice channel but does not record audio for this feature.

Speech Recognition (!listen)

When the Bot is explicitly commanded to join a voice channel and "listen", it captures raw PCM audio data. This audio is temporarily processed into text to generate AI responses. Voice recordings are not permanently saved or stored.

4. Virtual Economy and XP Systems

The Bot features a virtual economy including shopping, gambling, gacha banners, stealing mechanics, and an XP system.

No Real-World Value

Virtual currency (such as money or bank balance) and inventory items have zero real-world monetary value. They cannot be cashed out, sold, or exchanged for real money.

Economy Resets

The Bot developer reserves the right to wipe, alter, or reset economy balances, bank limits, inventories, and XP leaderboards at any time, with or without notice, to maintain balance or fix exploits.

5. AI & Generated Content Disclaimer

The Bot uses Artificial Intelligence, including local LLMs and external voice APIs, to generate text and text-to-speech audio.

Unpredictability

AI-generated responses may occasionally contain inaccurate, nonsensical, or inappropriate information.

Personas

The Bot is programmed with specific personas, such as "Kyoko", which influence its conversational style. Statements made by the AI do not represent the views of the Bot developer.

Liability

The Bot developer is not responsible for offensive, misleading, or harmful content generated by the AI.

6. Acceptable Use and Fair Play

When interacting with the Bot, you agree to use the system fairly.

No Exploiting

You may not exploit bugs, glitches, or unintended mechanics to gain unfair advantages such as extra currency, items, or XP.

No Spamming

You may not use macros, scripts, or automated self-bots to spam commands or farm XP.

Violating these rules may result in a permanent ban from using the Bot and deletion of your stored data.

7. Limitation of Liability

The Bot is provided on an "as-is" and "as-available" basis. The developer makes no warranties regarding uptime, reliability, or accuracy.

The developer shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Bot, including loss of server data or virtual currency.

8. Changes to the Terms

The developer reserves the right to modify or replace these Terms of Service at any time. Continued use of the Bot after changes constitutes acceptance of the updated Terms.
